Picapica, the leading supplier of candy products in the United States, uses only quality, all natural ingredient. Pica candy is a high-quality,ourmet variety of sugar-free candy made with nuts that grow in the dessert arid zones of Central and South America. There is a lot of debate as to who actually owns the rights to the “picapica” trademark. In this article, I’ll show you how you can easily identify a source of picapica dulce de novo (dessert of pure fruit flavor). In my opinion, the picapica trade name should be retained for the true dessert flavor and not shared with other companies that market their candy in this generic style.
According to a source close to the picapica business, several years ago the company had a trademark dispute with the confectioner Nestle S. Oncidium. According to this source, the Nestle Company was very concerned that picapica was being used in an unfair manner by competing companies. That’s why they pulled the trademark. The confectioner, however, maintains that he never had a contract or agreement with picapica-type companies. Because of that, he can not sell picapica dulce enchilados or any other type of candy dulces enchilados.
This story is reminiscent of the old joke about a couple who travels on vacation. While eating at a hotel restaurant, the husband hears a conversation in which the waiter claims to be selling picapica. The husband then asks, “What is picapica?” to which the waiter replies, “Pica pica!” (in Spanish).
This story, however, is just a bit of an exaggeration. Picapita has nothing to do with picnicking. There’s no such thing as picnicking with a pica at stake. Although it’s true that pica-type chocolates are tasty and relatively inexpensive, the confectioner could easily put a mark on his business by selling them illegally. The potential legal troubles could extend well beyond simply preventing him from getting paid for his hard work.
Pica Pica Candy Ingredients
The ingredients to make pica candy are much harder to trademark than the actual sweetener itself. It’s pretty much impossible to prevent someone from taking your patented ingredients and putting them into their own mixture. As soon as they use your combination, they have exclusive rights to your product and can legally place the mixture on a store shelf or start selling the product to the general public. Chances are good that a company will try to do just that with your recipe so make sure you protect your interests well.
There are ways to protect yourself against a company stealing your pica candy recipe, however. If you want to sell your product, you can offer a refund or a return policy. If customers think they got bad candy, they are more likely to tell others about the poor quality ingredients. If you don’t offer a guarantee, you may be opening yourself up to a lawsuit from a customer who thinks the company didn’t put any of its ingredients into the mix.
Another way to prevent this kind of thing from happening is to sign a non-disclosure agreement. That means that if a competitor finds out about this type of deal, they can’t use it to hurt your business. The agreement should state that neither the buyer nor the seller can discuss the deal without the other party’s permission. However, some sellers won’t enforce the agreement if they think the buyer has a good reason not to come clean.
A lot of times, the best thing for a confectioner to do is to simply stay away from selling the product altogether. They may be able to continue selling it under a non-exclusive agreement, but it will be at their own risk. They could end up having to sell the product to another third party company while violating the terms of their own agreement. They may also face hefty fines for fraud if the other party decides to use the ingredients in their own product without getting permission from the other party first. If a seller doesn’t want to be put out of business for using someone else’s formula, they should definitely sign an agreement for confidentiality.
